Being Economic With Justice

Josef Ackermann has just returned the 3.2 million Euros in Executive Bonuses that he manipulated out of Mannesmann AG in breach of shareholder's trust.
Like so many recent executive trials, this repayment was not accompanied by any acceptance of guilt by the defendant.
Obviously, this is just a standard case of "one law for the rich...". However, applying a similar adaptation of the law for more prosaic crimes would help to resolve the overcrowding in Britain's prisons - "I'll pay the money back to the dole but I don't admit I took it in the first place, your honour. So, I'll be off now". Some chance...
